Bavarian Guidelines – Coronavirus Mitigation – Effective 21 March Through at Least 3 April 2020

On 20th Sep 20, Dr. Markus Söder, Bavarian Prime Minister, announced new mandatory guidelines that support Bavaria’s efforts to mitigate the spread of the Coronavirus and calm public life.  In general, there is a curfew from now until at least 3rd April 2020. 

That evening Sascha Liebhardt, Chancellor of the New European College (www.new-european-college.com) sent the following information summarizing the key elements of these guidelines, which must be followed seriously. 

1. Everyone is urged to reduce the physical and social contact with other people outside the members of their own household to an absolutely necessary minimum. Wherever possible, a minimum distance of 1.5 m between two persons must be maintained. 

2. Restaurants are to be closed. Excluded is the handing over and delivery of take-away food. 

3. It is forbidden to visit:

  • Hospitals as well as preventive and rehabilitation facilities in which medical care comparable to that provided in hospitals is provided (facilities pursuant to § 23 para. 3 nos. 1 and 3 IfSG), with the exception of maternity wards and childrens’ wards for close relatives and palliative wards and hospices, 

  • Fully inpatient nursing facilities in accordance with § 71 Para. 2 of the Eleventh Book of the Social Security Code (SGB XI), 

  • Facilities for people with disabilities within the meaning of § 2 para. 1 of Book of Nine of the Social Security Code (SGB IX), in which integration assistance services are provided day and night, 

  • Residential communities providing outpatient care in accordance with Article 2(3) of the Pflegewohnqualitätsgesetz (PfleWoqG) for the purpose of outpatient intensive care (Intensive Care Act), in which outpatient care services provide services in accordance with Section 23(6a) IfSG, and 

  • Retirement homes and old peoples’ homes. 

4. Leaving one's own home is only permitted if there are good reasons. 


5. Good reasons are, in particular: 

  • The exercise of professional activities, 

  • The use of medical and veterinary care services (e.g. visits to the doctor, medical treatment; blood donations are expressly permitted) and visits to members of assisting professions where this is medically urgently required (e.g. psycho- and physiotherapists), 
     

  • Supply routes for everyday consumer goods (e.g. grocery stores, beverage markets, pet supplies, mail-order and mail-order businesses, pharmacies, drugstores, medical supply stores, opticians, hearing aid acousticians, banks and cash dispensers, post offices, petrol stations, car repair shops, cleaning and postal voting). The use of other services such as visits to hairdressers is not part of the daily needs, 
     

  • Visitation of life partners, the elderly, the sick or people with disabilities (outside institutions) and exercising custody in the respective private area  

  • Accompaniment of persons in need of assistance and minors (the accompaniment of the dying and funerals within the immediate family circle), 

6. The police are required to check compliance with the exit restriction. In case of a control, the reasons for the control have to be substantiated by the person concerned.

7. An offence against this general ruling can be punished as an administrative offence according to § 73 paragraph 1a No. 6 of the Protection against Infection Act.

8. Further orders of the local health authorities remain unaffected.

9. This general ruling is immediately enforceable according to § 28 para. 3, § 16 para. 8 of the Protection against Infection Act.

10. This general ruling shall come into force on 21.03.2020, 00:00 hours and shall cease to be effective at the end of 03.04.2020. The initial restrictions thus end on 03.04.2020, 24:00 hours

In simple terms: 

  • Grocery stores, doctors’ offices and banks will remain open  

  • The food supply in Bavaria will be maintained: There are no shortages and there are no shortages in sight. The German government, the suppliers of foods and goods are ensuring that there are no bottlenecks in the supply chain. If your supermarket is out of stock it will be refilled in the next days.  

  • Offices remain open but home office is strongly encouraged 

  • Restaurants will be closed.  Take-away, drive-in and deliveries are still allowed.  

  • Hairdressers, hardware stores, and garden centers will be closed until further notice.  

  • There will be no more visiting rights for hospitals, care facilities and nursing homes.   

  • Violation of these regulations is a punishable offence and may result in a fine of up to €25,000

You are allowed to leave your apartment if you have a valid reason, such as:  

  • Going to work 

  • Exercising outdoors: Walking, jogging, biking 

  • Visiting a doctor or seeking urgent medical care  

  • Shopping for necessary supplies: grocery and beverage markets, pet supplies, post offices, pharmacies, drugstores, medical supply stores, opticians, hearing care professionals, banks and ATMs, petrol stations, car repair shops, dry cleaners.  

  • Accompanying people in need of support and minors  

  • Caring for pets  

If the police stop you, you must be able to explain why and where you are going.
